Travel Insurance
Mama's Homestay does not provide travel insurance.
Customers are required to arrange their own travel insurance before participating in any tour. Insurance should cover, at minimum:
- Accidents and personal injury
- Medical treatment and emergency evacuation
- Trip cancellation or interruption
Medical facilities in remote northern Vietnam are limited. Advanced treatment may require transfer to Hanoi or another major city. All medical costs are the responsibility of the customer.
Luggage and Personal Property
Luggage storage is available at Mama's Homestay during the tour. However, Mama's Homestay cannot guarantee the safety of items stored in luggage storage.
Customers are advised to hand valuable items (passport, cash, electronics) to the receptionist for safekeeping.
Mama's Homestay is not responsible for loss, theft, or damage to personal property during the stay or tour.
Participants are responsible for their personal belongings during the tour.
Mama's Station is not responsible for loss, theft, or damage to personal property.
Third-Party Services
During tours, certain services may be provided by independent third-party businesses, including:
- Restaurants and food providers
- Homestays or accommodation providers along the route
- Local transportation services
- Mechanical repair services
- Other local service providers
These businesses operate independently and remain responsible for the services they provide. Mama's Station does not control these businesses and cannot be held responsible for their actions, omissions, or service quality.
Nature of the Activity and Acceptance of Risk
Motorcycle travel in the mountainous region of the Ha Giang Loop in Ha Giang Province, Vietnam involves significant inherent risks. These risks include, but are not limited to:
- Motorcycle accidents or traffic collisions
- Difficult mountain roads, gravel surfaces, steep terrain, and sharp curves
- Weather conditions including rain or fog
- Landslides or other natural hazards
- Mechanical failures
- Illness or injury during the tour
- Limited access to advanced medical facilities in remote areas
By participating in this tour, participants acknowledge that these risks exist and cannot be completely eliminated even when reasonable precautions are taken. Participation in the tour means these risks are voluntarily accepted.
Responsibilities of the Tour Operator
Under the Vietnam Tourism Law 2017 (Law No. 09/2017/QH14), tourism service providers must take reasonable measures to support the safety of tourists and provide services according to the agreed tour program.
Mama's Station agrees to:
- Provide information about the tour route and itinerary
- Provide guides or Easy Riders when included in the tour package
- Take reasonable safety measures during the tour
- Assist participants in emergencies when reasonably possible
Participants acknowledge that tours take place in remote mountainous regions where conditions may be unpredictable and emergency services may be limited.
Motorcycle Operation and Rider Responsibility
Participants who choose to operate a motorcycle themselves confirm that they:
- Possess a valid motorcycle license legally recognized for use in Vietnam
- Have sufficient riding experience to safely operate a motorcycle in mountain conditions
- Understand and will follow Vietnamese traffic laws
Participants accept full responsibility for operating the motorcycle. If a participant chooses to ride without a valid license or without sufficient experience, they accept responsibility for any consequences, including accidents, injuries, vehicle damage, and legal penalties or fines.
Mama's Station is not responsible for accidents resulting from illegal or unsafe riding.
Easy Rider Passenger Transport
Participants who ride as passengers with an Easy Rider acknowledge that motorcycle travel still involves inherent risks.
Passengers agree to:
- Wear a helmet at all times while riding
- Follow safety instructions from the driver
- Remain seated properly
- Not interfere with the operation of the motorcycle
Mama's Station selects drivers with local riding experience and knowledge of the route. However, accidents may still occur due to road conditions, weather, or actions of other road users.
The tour operator will provide reasonable assistance in case of accident or emergency but cannot guarantee the prevention of accidents.
Alcohol and Substance Use
Operating a motorcycle under the influence of alcohol or drugs is illegal under Vietnamese traffic law and extremely dangerous.
Participants agree that they will:
- Not operate a motorcycle while intoxicated
- Ride with an Easy Rider or use alternative transport if they consume alcohol
- Accept responsibility for any consequences resulting from riding under the influence
Mama's Station reserves the right to:
- Refuse motorcycle access to intoxicated participants
- Require intoxicated participants to ride as passengers
- Remove participants from the tour if their behavior creates a safety risk
Any accidents or legal consequences resulting from alcohol or drug use remain the responsibility of the participant.
Motorbike Damage and Recovery Responsibility
Motorcycles used during the tour remain the property of Mama's Station or its partners.
Participants agree to operate the motorcycle responsibly and follow safety instructions.
Participants may be responsible for repair or replacement costs if damage results from:
- Reckless or unsafe riding
- Riding under the influence of alcohol or drugs
- Violation of Vietnamese traffic laws
- Operating the motorcycle without a valid license
- Ignoring safety instructions from guides
If a motorcycle becomes damaged or abandoned due to the participant's actions, the participant may also be responsible for reasonable costs related to:
- Vehicle recovery and towing
- Transport of the motorcycle
- Necessary repairs
Normal mechanical failures not caused by the participant remain the responsibility of the tour operator.
Compliance with Vietnamese Law
Under the Vietnam Tourism Law 2017 (Law No. 09/2017/QH14), tourists must:
- Comply with Vietnamese laws and regulations
- Respect local customs and culture
- Follow safety instructions provided by tourism service providers
Participants agree to comply with all Vietnamese laws, including traffic regulations. Any fines, penalties, or legal consequences resulting from a participant's actions remain the responsibility of the participant.
Police-related charges incurred by Mama's Station due to a participant's actions will be passed on to the responsible individual.
Tour Changes for Safety Reasons
Mountain travel conditions may change due to weather, landslides, road damage, or safety concerns.
For safety reasons, Mama's Station reserves the right to modify the route, itinerary, accommodation, or daily schedule when necessary. Such decisions are made to protect the safety of participants and staff.
No refund is provided for route or schedule changes made for safety reasons.
Limitation of Liability
To the maximum extent permitted under Vietnamese law, Mama's Station and its staff are not liable for:
- Injuries resulting from the inherent risks of motorcycle travel
- Accidents caused by participant behavior or riding ability
- Acts or negligence of third-party service providers
- Weather conditions, road hazards, or natural events
- Loss or damage to personal belongings
Nothing in this agreement excludes liability where such exclusion is prohibited under Vietnamese law.
Emergency Situations
Participants authorize Mama's Station to assist in arranging medical care or evacuation if the participant is injured or unable to make decisions.
All associated costs remain the responsibility of the participant unless covered by insurance.
Governing Law and Jurisdiction
These terms are governed by the laws of the Socialist Republic of Vietnam.
Any disputes shall fall under the jurisdiction of the competent courts of Ha Giang Province, Vietnam.
Any disputes arising from participation in the tour shall fall under the jurisdiction of the competent courts of Ha Giang Province, Vietnam.
